TYPES OF BENEFITS YOU CAN GET THROUGH WORKERS' COMPENSATION

1) MEDICAL BENEFITS

California Labor Code grants injured workers a right to receive medical treatment for work-related injuries or illnesses. Medical care may include hospitalization, physician visits, diagnostic and other lab procedures, medical equipment, prescription medications, and travel expenses for medical appointments.

One persistent misconception among workers is a notion that workers’ compensation covers only orthopedic injuries, such as broken bones, dislocations or sprained muscles or ligaments. However, the workers’ compensation system allows for any types of injuries to any body systems so long as there is proof that these injuries were caused in the course of work. This includes injuries to the psychiatric system, neurological system, cardiovascular system, gastrointestinal system, burns, Covid-19 consequences, strokes, heart attacks, severe depression, cancer, lung diseases and many other conditions.

2) TEMPORARY DISABILITY

Temporary disability benefits are payments equivalent to 2/3 (up to a cap) of an injured worker’s earnings that are meant to substitute lost wages due to a work-related injury or illness. Temporary disability benefits are provided while an injured worker is getting treatment and recovering from the injury. There is a cap in most cases of two years for this type of benefits, although certain exceptions apply.

3) PERMANENT DISABILITY

Permanent disability benefits are the monetary measure of the permanent body damage that an injured worker sustains in the course of work, affecting their ability to compete in the open labor marker, i.e. be a competitive worker. In California, the legislature and judiciary created an intricate way of determining the extent of the permanent disability an injured worker has, which depends on the actual physiological impairment, age, occupation and other factors.

4) SUPPLEMENTAL JOB DISPLACEMENT BENEFITS

Supplemental Job Displacement benefits provide for vouchers that injured workers can use to pay for retraining.

5) DEATH BENEFITS

California Labor Code provides the dependents of a deceased family member with a right to recover benefits for a work-related death. Death benefits comprise burial expenses as well as lost income, depending on the number and type of dependents. In some cases, total dependents can receive up to $250,000. It is important to remember that a claim for death benefits should be filed within a year of your loved one passing and no more than 240 weeks after a fatal injury is incurred, although some exceptions apply.
